Court allows client back into her home after eviction

A young mother with three children approached Moss & Co after they had been evicted from their housing association property.

She had been working part-time and had not realised that her Housing Benefit had stopped. On hearing that she was to be evicted she had gone to the Court and was told there was nothing she could do to stop the eviction unless she paid an application fee of £40 which she did not have. The eviction went ahead. We acted on an emergency basis to get her Legal Aid and applied to the court for her to be readmitted to the property. We sorted out her Housing Benefit so that she received a substantial back payment clearing all the arrears.

Note: It is very difficult to get the Court to order readmission once an eviction has taken place. Always take action and consult a solicitor  before you are evicted.
