What is a lawful Arrest?
The police must caution you before arrest. They can only make an arrest if they have reasonable grounds to suspect a criminal offence has or is about to committed. They can also arrest you on a warrant or if you give them a false or name and address. Sometimes police can arrest someone who they think is danger to themselves or others.
Your rights

You must be allowed to inform someone of your arrest unless to do so might interfere with the investigation or the arrest of others.

You have the right to remain silent. You may demand legal representation and may not be interviewed until your representative arrives. Voluntary Police Interviews
If the police will invite you in for interview you should contact us immediately. We will call the officer and arrange a suitable time for you to attend with us. We can also get information from the police and give you comprehensive advice at our offices.
Legal advice is important so that you are not tempted to answer questions to try and get out of the station as quickly as possible. Your chances of a good result are much better with a solicitor present.

When to ask for a duty solicitor at the police station
If you do not have a solicitor of your own you can always choose us or ask you friends or family to find a solicitor for you.
Can the officer refuse to let me see a police station solicitor?
Only in very serious cases when advice may be delayed on the authority of a senior officer, but this can never be for more than 36 hours (or 48 hours in terrorism cases)
Do I have to use the duty solicitor?
Certainly not. You are free to choose you own solicitor whether paid for by the Legal Aid Agency or paid for privately.
When will I get my seized phone or computer back
It can take many weeks for the police to download and assess the data on a phone or computer. Your property will be retuned at the end of the investigation or court case if you are charged.
Do I have to provide my PIN
No, you do not unless the police obtain an order under section 49 of RIPA. Even if an order is obtained you cannot be forced to give your PIN or password, but it is an offence not to do so punishable by up to 2 years imprisonment.
What does released under investigation (RUI) mean?
It means the investigation is ongoing but that there are no bail conditions. There is no time limit on how long this may take. Any new evidence that comes to light in this period might be used against you. We always chase up the police to find out the position.
